DMCA Policy
Sneaky Spaghettios respects the intellectual property rights of others and expects its users to do the same. This policy is designed to comply with the Digital Millennium Copyright Act (DMCA) and provides a clear process for reporting alleged copyright infringement and for submitting counter-notifications.
It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Sneaky Spaghettios website, please notify our designated copyright agent as set forth below.
Filing a DMCA Notice of Infringement
To file a DMCA notice of infringement with Sneaky Spaghettios, you must provide a written communication (by email or regular mail) that substantially includes the following:
- Identification of the copyrighted work claimed to have been infringed: This must include a description of the copyrighted work, and if possible, a copy or the URL of an authorized version of the work.
- Identification of the material that is claimed to be infringing: This must include a description of the material and the URL(s) or other specific location(s) on the Sneaky Spaghettios website where the material is located. Enough information should be provided to allow us to find the material.
- Sufficient information to permit Sneaky Spaghettios to contact you: This includes your full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your electronic or physical signature. (A scanned signature or typed name with an explicit statement of intent to sign is acceptable for electronic submissions.)
Upon receipt of a valid DMCA notice, Sneaky Spaghettios will promptly investigate the matter and take appropriate action, which may include removing or disabling access to the infringing material.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our designated DMCA agent. To be effective, a counter-notification must be a written communication that includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Sneaky Spaghettios may be found), and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
- Your electronic or physical signature. (A scanned signature or typed name with an explicit statement of intent to sign is acceptable for electronic submissions.)
Upon receipt of a valid counter-notification, Sneaky Spaghettios will provide the claimant with a copy of the counter-notification. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at Sneaky Spaghettios’s sole discretion.
